When you make a booking to attend our Retreat, you are agreeing to all these Terms and Conditions:
1. Your Health
We’re really looking forward to seeing you at the Retreat. However, it’s important to us, our staff and all other participants that you stay safe and well and are able to participate meaningfully in our program. It is your responsibility to let us know about all relevant physical and mental health issues that could affect your participation in, and enjoyment of the program. We may ask you to provide advice from your health professional confirming your fitness to participate. If we consider that your physical or mental condition is such that that your safety, or the safety of other participants, could be compromised, we may ask you to withdraw from participation in particular activities, or the Program as a whole.
If you require medications or pharmaceuticals (including inhalers and EpiPens) it is your responsibility to bring, maintain and administer these while you are at the Retreat in accordance with your doctor’s advice.
If you are feeling unwell or are unsure about travelling, please get professional advice before coming to the Retreat.
We work to create an inspiring and culturally safe space for personal development in a collegiate group environment. The program activities are not designed as personal counselling or therapy sessions and if you are looking for that type of program, this may not be the right program for you. There are no 1:1 sessions with facilitators, nor is the program therapeutic.
There is no doctor, psychologist or nurse at the Retreat. The closest hospital is 35 minutes away by car. If you need urgent medical attention or hospitalisation, we will call an ambulance. You are responsible for all costs associated with any treatment required.
Some aspects of the program may be difficult for participants with reduced mobility. While the accommodation and program venue at NewFarm is wheelchair accessible, the program includes excursions to natural locations that are not. While no element of the program and activities is compulsory, it is important that you understand this. There is no discount or refund for activities you do not participate in.
We may travel to Greens Pool which is an unpatrolled beach that can have strong surf and rips. If you are not a confident swimmer, you should not enter the water.
You accept all risks associated with swimming, physical exertion, bush walking, and exposure to the sun or adverse weather.
2. COVID-19
You may need to provide us with evidence of a negative RAT in the 48 hours before arrival if we deem it applicable. If you test positive for COVID-19 we require evidence of a medically supervised RAT or PCR test within the previous 48 hours OR evidence of notification of your diagnosis to the WA Government to receive a full refund, less 20% administration fee. If you display symptoms at the Retreat, we will ask you to undertake a RAT under our supervision and you agree to comply with any such request. If you test positive at the retreat you will be required to isolate until you can organise your own exit from the property.
3. Deposits and Payments
Following receipt of your Expression of Interest, we will notify you if a place is available and, if so, send you an invoice. You can accept the offer of a place by paying the deposit of 50% by direct deposit into our bank account. Your place is not confirmed until payment has been received by us. We will not issue a reminder.
It is your responsibility to pay the full balance by the due date. Failure to do so will be deemed notice of cancellation and your deposit may be forfeited in accordance with our Cancellation Policy.
We do not accept credit cards. Payments must be paid by direct deposit to our bank account and/or via the website.
4. Cancellation Policy
All cancellations must be in writing. If you cancel by close of business 12 weeks prior to the event start date, we will refund your deposit less a 20% administration fee.
If you cancel by close of business 8 weeks prior to the event start date, your 50% deposit will be forfeited and the balance refunded to you.
If you cancel on or after 4 weeks prior to the event date, there is no refund. We hope this doesn’t happen but it’s possible that we may need to cancel the Retreat. We reserve the right to do so if we think it necessary. If so, we will refund your entire payment.
5. Travel Arrangements
You are responsible for your own travel arrangements to and from NewFarm to attend the Retreat. While most of the program takes place at NewFarm, optional excursions to nearby places of interest may be arranged. You can use your own vehicle or carpool with another participant; however, this is at your own risk. We are not responsible for any damage or injury you may sustain while driving yourself or as passenger in a vehicle.
6. Venue and Accommodation
We plan to conduct the Retreat at NewFarm, Denmark. If, for any reason, NewFarm becomes unavailable, we reserve the right to arrange an alternative venue and will notify you accordingly. We will endeavour to provide you with your choice of accommodation at NewFarm; however; we reserve the right to provide alternative accommodation if your choice is, or becomes, unavailable.
7. Meals
All meals are provided. Alcohol is not provided; however, you may bring your own alcohol. We request that you notify us of any food intolerances or allergies; however, we cannot guarantee to cater for all allergies and intolerances. It is your responsibility, which may include bringing your own food with you to ensure that you have access to suitable meals. There is no discount or fee reduction if this occurs.
8. Program and Staff Changes
We endeavour to arrange qualified and experienced facilitators to provide a rich and inspiring program. We reserve the right at any time to alter the Program or use different facilitators to those who have been profiled in our marketing.
9. Valuables
You are responsible for the security of your vehicle, personal possessions and valuables. Neither we nor NewFarm have any responsibility for any damage, breakage, loss or theft at the Retreat. You understand that the nature of the accommodation is such it is not possible to lock or secure tents.
10. Code of Conduct
You must act with respect and courtesy toward all staff (including NewFarm staff) and every other participant at all times. We do not tolerate aggression, bullying, discrimination or other anti-social behaviour in any form. If we consider that your behaviour fails to meet this standard or is compromising our ability to deliver the Program, we reserve the right to require you to cease participation in the Retreat immediately. In those circumstances, you must leave NewFarm straight away at your own expense. There is no refund of any portion of the Retreat fees.
11. Privacy
We are committed to respecting the privacy of your personal information. Personal information you provide to us will only be used to facilitate your participation in the Retreat, to contact and communicate with you and for our internal record keeping. We will not provide your personal information to any third parties other than on a ‘need to know’ basis for these purposes.
12. Warranty
You warrant and confirm that the information provided to us is correct and that you have disclosed to us all allergies, medical, psychological or other conditions which may affect your wellbeing during the Retreat or your ability to participate fully in the Program.
13. Release
You release us from and against any liability arising out of any injury, loss, damage or death caused to you or your property or any other person arising from or in connection with my participation in the Retreat whether such injury, loss, damage or death was caused directly or indirectly by negligence, breach of contract or any way whatsoever. You agree to indemnify us from all claims, damages, losses, injuries and expenses arising out of or resulting from your participation in the Retreat and its associated activities.
14. Jurisdiction
Once you have paid your deposit, these terms and conditions create a binding contract between us which is governed by the laws of Western Australia. You accept the jurisdiction of the Courts of that State.
We reserve the right to alter these terms and conditions at any time without notice.
